Prerrogativas

The prerogatives of lawyers are provided by Law No. 8,906 / 94 in Articles 6 and 7. The law provides for this professional the right to exercise full defense of their clients, with independence and autonomy, without magistrate fear, the public prosecutor or any authority that might try to embarrass him or diminish its role as defender of freedoms.

These rules ensure, for example, that a lawyer has the right to consult a process even without a proxy, or in cases of criminal proceedings and investigations protected by judicial secrecy. That is, are fundamental guarantees provided by law, designed to ensure the wide right of defense.

professional prerogatives should not be confused with privileges because they deal only to establish safeguards for the lawyer as a representative of the legitimate interests of its clients.
